In Chile, after the last plebiscite on October 25, we are at a crucial moment to debate on various issues, including whether or not to regulate animals in the constitution.<\/p>\n

If we decide to consecrate animals in the Fundamental Charter, we could initiate a change in the legislation in this area, bringing positive consequences for the animals. To do this, it is important that we look beyond our borders for inspiring legislation and, in this case, Europe has a lot to offer.<\/p>\n

In this sense, Switzerland is a benchmark country in the matter, due to the strict legislation on animal welfare since it is the only country that protects the dignity of animals at the constitutional level, a clear example of the above being the fact that making it illegal to throw a conscious lobster into boiling water. In the same way, Germany is also a good model to analyze, because the protection of animals was given constitutional status in 2002 and one of the recent laws passed on this matter is the prohibition of the mass slaughter of animals. chicks as of 2022.<\/p>\n

In line with the above, it seems to me that the European Union (EU) is not far behind in these matters, establishing in the Lisbon treaty the obligation on the part of the member states to treat animals as \u201csentient beings\u201d in the legislation internal of each of the states. There are several areas in which the EU has looked after animal welfare, for example when it eliminated animal testing on beauty products in 2013.<\/p>\n

It is also important to note that the plenary session of the European Parliament adopted, on May 3, 2018, a resolution calling for a worldwide abolition of animal testing in the cosmetic industry.<\/p>\n

Finally, it is essential to understand that enshrining animals in the constitution will not automatically give them greater protection on a day-to-day basis, but it will be the starting point around which to legislate. We have already seen that the law of responsible pet ownership, better known as the \u201cCholito Law\u201d, has not brought the expected effects since the abandonment of pets has not decreased; furthermore, due to the drafting and articulation of the norm, the inapplicability of a large part of its precepts will be made.<\/p>","protected":false},"excerpt":{"rendered":"
