Teaching Assistant of the European Studies Program<\/strong><\/p>\n<p>Until today, the\u00a0<strong>State of Chile<\/strong>\u00a0has not met the goal proposed by the Undersecretariat of Finance that set the year 2020 as the deadline for the promulgation of the bill that largely modifies the current law 19,628, on<strong>\u00a0Protection of Private Life (Lpvp)<\/strong>. This rule, in force since 1999, established our country as pioneers in the protection of personal data, giving way for the rest of the globe to proceed with its regulation.<\/p>\n<p>Now we have fallen behind and outside the standards of the<strong>\u00a0Ocde<\/strong>\u00a0for the treatment of this matter. This organization has become aware of the Chilean situation, urging both its updating and the taking of measures that provide greater coverage to the rights of data holders.<\/p>\n<p>It aims to implement substantial reforms - closely following the comparative experience - especially bearing in mind the\u00a0<strong>General Data Protection Regulation of the European Union (Rgpd) of 2018<\/strong>, which set high standards. This favored the delivery of confidence to its population regarding the treatment of data as a consequence of the advancement of technologies (e-commerce, the creation of big data, the\u00a0<strong>Internet of Things (IoT)<\/strong>); thus increasing the pressure for other countries to adapt to this paradigm shift.<\/p>\n<p>On the other hand, it is worth highlighting the sustained discussion that has taken place in various sessions of the Congress of the Future, regarding a bill and constitutional reform, already approved by the Senate, in which the possibility of legislating on the so-called\u00a0<strong>neuro rights<\/strong>. This initiative, proposed by Dr. Rafael Yuste, in charge of the\u00a0<strong>BRAIN project<\/strong>, search through the\u00a0<strong>neurotecnolog\u00edas el mapeo<\/strong>\u00a0of brain activity for altruistic purposes. I believe that these \"new rights\" or emerging rights, and following modern doctrines, could well be classified as fourth generation rights (related to the information society), which would be incorporated into the constitution.<\/p>\n<p>At the same time, it is still striking that the bill is referred to the\u00a0<strong>Lpvp<\/strong>\u00a0by cataloging neurodata as a \u201c<strong>special sensitive data<\/strong>\u201d. Based on the foregoing, is it possible to think that Chile could be one of the pioneer countries in the incorporation and legal treatment of this new matter, if it is not even capable of self-regulation and updating related current provisions?
